1. Commission sets out changes to intellectual property rules for integrated projects

A working document on 'Provisions for implementing integrated projects,' published by the European Commission's Research DG on 21 January, sets out measures to make the intellectual property rules for integrated projects under the Sixth Framework programme for research (FP6) simpler and more flexible.

The document sets out changes to the rules regarding the protection, dissemination and use of knowledge under integrated projects, so that the same guidelines apply for all participants. They have also been adapted to aid efficient cooperation and the appropriate use and dissemination of results. Under the simplified rules, participants may also decide amongst themselves the arrangements that suit them best, within the framework of the model contract.

The document states that participants in integrated projects will own the intellectual property of the knowledge resulting from the project, adding that 'where appropriate, the owner of knowledge will provide adequate and effective protection for knowledge that is capable of industrial or commercial application.' It adds that the Commission may adopt protective measures where necessary to protect knowledge in a particular country or where such protection has either not been applied for or has been waived.

The document also sets out provisions for the mandatory use and dissemination of knowledge. It states that participants are free to use any knowledge arising from the project which they own, according to their own wishes and in compliance with any agreement reached by the group involved in the project. The document also states that participants will be given a time limit by the Community for the dissemination of knowledge suitable for this. If the participants fail to do this within the period laid down by the Community, the Commission may take action to disseminate the knowledge itself, bearing in mind the need to safeguard intellectual property rights, confidentiality and the legitimate interests of the participants.

The document also sets out a simplification of access rights so that the same provisions apply to all participants. This represents a break away from the practice adopted under the Fifth Framework programme for research, FP5, where there were different access rights for principal and assistant contractors. In addition, the control of pre-existing know-how by its owners has been improved by making it possible for a participant to exclude pre-existing know-how from the obligation to grant access rights to it to other participants. The control of knowledge resulting from a project by its owners has also been improved

- a project participant enjoys access to another participant's knowledge or pre-existing know-how only where these rights are necessary for that participant to use his or her own knowledge to carry out work under the project or to use their own knowledge resulting from the project.

Although obligatory access rights between projects have been suppressed, participants may themselves draw up an agreement to grant additional or more favourable access rights or to specify the requirements applicable to access rights. The Commission may, however, object to the granting of access rights to third parties, particularly if they lie outside a Member or Associated State, if the grant is not in accordance with the interests of the competitiveness of European industry or ethical principles such as those described in the EU Charter of Fundamental Rights.

Access rights to knowledge and pre-existing know-how will be granted on a royalty-free basis unless other conditions are agreed before the contract is signed.

2. IRC workshop focuses on legal aspects of international trade

A seminar addressing international licences, supply and sales contracts, organised within the framework of northern Germany's Innovation relay centre (IRC) and supported by the European Commission's Enterprise DG will take place in Teltow, Germany on 21 to 23 February.

The event will tackle the structure of national and international contract laws, the negotiation and drawing up of contracts, transactions, payments and payment security, trade representatives, the creation of 'know-how', the advantages and disadvantages of licences and cooperation.

The seminar aims to give confidence to those who are not lawyers to deal with legal aspects of international trade.

3. European Parliament to join debate on ICT in schools

An event organised by the European Parliament and European Schoolnet, 'Innovation and excellence in school: moving Europe ahead!' will discuss ways to improve the use of ICT (information and communication technologies) in schools in Brussels on 18 February 2002.

The day-long debate will look at ways of increasing Europe's educational innovation and excellence by improving the use of ICT in schools. Education experts and European Commission and political representatives will attend the event, which will include a presentation by the new President of the European Parliament, Patrick Cox.

The morning session of the event will examine the issue of 'Making change happen in schools,' and the afternoon session will address the topic of 'Identifying a strategy for action.' The programme also includes a round table discussion with leading MEPs on 'ICT policies and actions for moving Europe ahead.'

4. Investigating nanotechnology

Two events held in London will examine the future of nanotechnology in spring 2002.

On 19 March scientists, industrialists and investors will gather at the event to discuss nanotechnology applications and future potential. The event is specifically targeted at the investment community, including business angels, venture capitalists and investment fund managers.

The event will offer an opportunity for organisations to meet and interact with key figures at the highest level in the European nanotechnology community.

On 24 and 25 April, a two day conference will explore the question of 'Nanotechnology

- the next industrial revolution?'

Entrepreneurs and futurists will present their work and share technologies which revolutionise day to day life. Delegates will learn about the new business opportunities that nanotechnology presents and how nanotechnology is already having an impact on products as diverse as novel foods, retinal, cochlear and neural implants, pigments and coatings, personal health diagnostics, security and crime detection, space medicine, smart paints, disposable displays, games and entertainment.

5. Scientists to discuss latest breast cancer research at Spanish conference

The third European breast cancer conference, with more than 3,000 scientists, clinicians and patient representatives will take place in Barcelona, Spain on 19 to 23 March.

6. Commission to request study on contribution of business services to growth

The aim of the study is to examine the role of business services in the economy, in particular their impact on growth and productivity in the manufacturing and other service sectors. Tasks include the further development of the analytical research framework and analysis of the policy implications of such changes in Europe. The workload is estimated at 200 man days. The total contract duration will be 10 months.

7. Prior information on JRC staff survey tender

8. Transfer of ITC between Europe and Asia - call for proposals

The European Commission has issued a call for proposals for the co-financing of joint projects to enhance the transfer of information and communications technology (ITC) between Europe and Asia.

The areas of activity relevant for this call are agriculture, education, health, society, transport, tourism, intelligent manufacturing and electronic commerce.

Each activity should take place under one of the following headings:

- Get-in-touch and keep-in-touch activities Supports the identification and linking of organisations in the form of task forces, workshops, seminars and conferences to search, specify and assess compatible solutions for adaptation between European and Asian IT & C environments.

- Short (university level) courses Supports courses and workshops of a graduate or post graduate standard, in either business or university contexts, to explore and transfer know-how or search for solutions around key IT & C issues.

- Information society interconnectivity Supports operations to substantially improve, publicise and intensify direct communication connections and electronic traffic both between European and Asia, and within Asia. Organisations who invest in the improvement of direct interconnectivity can be assisted by this instrument in order to facilitate the strengthening of the communications network between the continents. Operations which are closely linked to such investments, will also be supported, as are those that aim to improve the quality, reliability and security of connections.

- Liaise with European IT & C initiatives and programmes Supports the identification and establishment of task forces, workshops and/or other events which aim to facilitate and improve contacts and/or participation in and the transfer of know-how by Asian IT & C expertise to the development and implementation of existing European IT & C initiatives, for example, under the Community research and technological development (RTD) Framework programme.

- Understanding European and Asian regulatory and legislative organisation structures Supports studies, task forces, workshops, seminars and/or conferences with the aim of improving mutual understanding of European and Asian IT & C regulatory and legislative organisation structures, their capabilities and shortcomings and the identification and definition of improvements that could be realised through the use of IT & C to achieve this goal.

- Practical demonstration projects Supports demonstration of ITC practices and techniques from either the European Union in Asia or vice versa. This programme component is seen as complementary to the preceding components, and prior activity in these components is recommended.

The geographical area covered by the call is the EU and the following Asian countries: Afghanistan, Bangladesh, Bhutan, Brunei, Cambodia, China, East Timor, India, Indonesia, Laos, Malaysia, Maldives, Nepal, Pakistan, Philippines, Sri Lanka, Thailand and Vietnam.

Projects should last for a maximum of 36 months, and the overall amount available for this call is 14 million euro. A maximum of 100 grants will be awarded.

9. Italian conference to examine role of Internet in local government

The EISCO 2002 conference on 'Internet portals and the re-engineering of local and regional governments in Europe' will take place in Cagliari, Italy, from 27 to 29 May 2002.

The event is being organised by the Elanet network under the sponsorship of the region of Sardinia and the European Commission's Information Society DG. It will examine the issues of e-government, e-democracy and technological innovation for local economies. It will also look at new approaches in European research, including the role of the Sixth Framework programme for research (FP6) . Speakers will include representatives from the Information Society DG and local and regional government associations.

Elanet (the European local authorities' telematic network) operates under the umbrella of CEMR (the Council of European municipalities and regions) . It focuses on the deployment of information society measures at regional and local level. At present, the network consists of representatives from 19 European countries, including the 15 EU Member States.

10. Prior information on study to evaluate integration of sustainability into Community policies

The European Commission has issued prior information on a call for tender for an evaluation of the approaches to integrate sustainability into Community policy.

The objective of the programme will be to assess to what extent several major Community policies integrate the dimension of sustainable development and to develop an understanding of the problems and constraints with doing so in the future.

The Gothenburg European Council recognised sustainable development as one of the main cross-cutting priorities for the years to come. Sustainable development can be seen as a framework with which each Community policy has to comply, through a proper balance of economic, social and environmental policy considerations. Several major areas of Community policy are concerned, including the Common Agricultural Policy, the Common Fisheries Policy, transport policy and the structural funds.

The proposed strategic evaluation will examine the consistency of these policies with the sustainability dimension and their effectiveness in integrating it from the outset in their design.
